Shared Tips About Pay Rules for NCR 2026 — Minimum Wage & Compliance

Pay rules in the National Capital Region (NCR/Metro Manila) are governed by the Regional Tripartite Wages and Productivity Board (RTWPB–NCR) under the Department of Labor and Employment (DOLE). As of October 2026, the applicable wage order is NCR–28, which took effect on 26 September 2026, following litigation that suspended the earlier NCR–27 .

Current Minimum Wage Rates (NCR–28)
Rates are daily basic wages, covering all private-sector workers regardless of status or pay method :

Sector Daily Minimum Wage
Non–Agriculture (most businesses) ₱755 (₱60 increase from ₱695)
Agriculture, Service/Retail ≤15 workers, Manufacturing <10 workers ₱718 (₱60 increase from ₱658)

These rates apply across all 16 cities and the municipality of Pateros . Approximately 1.1 million workers benefit.

Background & Legal Status
- Wage Order NCR–27 (June 2026) had proposed a total ₱85 hike in two tranches: ₱60 effective July 25, 2026, plus ₱25 on January 20, 2027. However, it was enjoined by the courts and remains pending .
- Wage Order NCR–28 was issued as the operative measure, granting a flat ₱60/day increase effective 26 September 2026 .
- Domestic workers are covered separately under WO NCR–DW–06, with a minimum monthly wage of ₱7,800 effective 7 February 2026 .

Key Pay Computation Rules
The new basic rates serve as the base for all statutory benefits:

- Overtime pay: ≥25% premium (30% on rest days/holidays) of the daily rate
- Night shift differential: +10% per hour between 10 PM–6 AM
- Holiday pay: 100% for regular holidays; 30% special non-working days
- 13th-month pay: computed from actual basic earnings, pro-rated within the year
- Service incentive leave, separation pay, and retirement pay are similarly tied to the adjusted basic wage

Compliance & Enforcement
- No reduction of existing benefits is permitted; higher company rates remain protected .
- Employers must post the wage order in a conspicuous workplace location. Payslips must clearly reflect the adjusted basic pay.
- Violations carry penalties under RA 6727 / RA 8188, including back wages, fines, and potential closure through DOLE inspection.
- Sagip Trabaho Program: Qualifying SMEs may apply for temporary government subsidy covering the ₱60 differential from October–December 2026 to ease implementation costs. Exemption mechanisms exist for firms unable to absorb costs, subject to financial review.

The status of a second tranche (₱25 additional) remains tied to the pending court decision on NCR–27. Employers should monitor official DOLE/NWPC announcements for updates.

In summary, as of October 2026, NCR employers must pay at least ₱755/day (non–agriculture) or ₱718/day (smaller/agricultural establishments), with all derived benefits recalculated accordingly.
